Immigration to Germany has been made easier

The "Act to Amend the Skilled Workers Immigration Law" offers a new opportunity for skilled workers from non-EU countries. The new immigration law for workers also expands the possibilities for entering Germany to have foreign professional qualifications recognized. It is important to note that individuals who wish to practice a regulated profession in Germany require this recognition. Such recognition provides long-term advantages for integration and future prospects in Germany and is also beneficial in other professions.

These new regulations will gradually come into effect starting in November 2023.

Changes from November 2023  
1. Facilitations for University Graduates with the EU Blue Card:

   - Income thresholds have been significantly lowered.
   - The number of eligible applicants has increased.
   - The list of eligible occupations has been expanded.
   - Short- and long-term mobility is facilitated.
   - Family reunification has been simplified.
   - IT specialists with relevant work experience can obtain the Blue Card without a degree.

2. Rights for Skilled Workers:
   - Skilled workers with vocational or academic training are entitled to a residence permit if all conditions          are met.
   - Skilled workers with vocational or academic qualifications can work in any non-regulated field.
   - Employment of professional drivers is made easier.
   - Training and employment no longer need to be directly related.

Changes Effective from March 2024  
1. Residence for Professional Recognition:

   - Individuals participating in adaptation training courses or compensation programs can enter and stay in        the country for up to three years.
   - Candidates can work up to 20 hours per week.

2. Recognition Partnership:
   - Individuals from non-EU countries can enter Germany first and then undergo the recognition process.
   - The responsibility for actively pursuing the recognition procedure lies with the skilled worker.
   - Requirements: recognized vocational or academic qualification and at least two years of experience in          the desired profession.
   - An alternative diploma from the German Chamber of Commerce Abroad may suffice under certain            conditions.
   - IT specialists do not need a diploma.

3. Other Changes:
   - Improved labor market access for nursing staff.
   - Permanent residency for foreign skilled workers.
   - Simplification of family reunification.
   - Employment opportunities for students and interns.

Changes Effective from June 2024 
1. Introduction of the Opportunity Card:

   - Nationals from non-EU countries can enter with the new job search visa, the Opportunity Card.
   - Full recognition of qualifications may play a role, as fully recognized professionals can obtain the                   Opportunity Card without additional conditions.
   - Requirements for others: recognized vocational or academic qualification from the country of training        or a diploma from the German Chamber of Commerce Abroad under certain conditions.
   - Language requirements: Basic knowledge of German (A1 CEFR level) or English (B2 CEFR level).
   - Additional requirement: at least six points based on a points system that evaluates criteria such as                  professional qualifications, language skills, work experience, ties to Germany, and age.​​
